What these terms cover

These terms cover this website and the things you can do through it: reading the pages, downloading the app, joining the monthlet AI waitlist, and contacting us.

The app is covered by its EULA, not by these terms. The licence to install and use the software, what you may and may not do with it, where your notes are stored, how your AI provider API keys are held, and the licences of the open source software included in the app are all set out in the EULA. It is shown in full when you first launch the app and can be reopened from the app’s settings.

How your information is handled is set out in the Privacy Policy. These terms do not restate it.

If these terms and the EULA appear to conflict about the software itself, the EULA prevails. If they appear to conflict about this website or a service offered through it, these terms prevail.

What we provide today

Today this website offers: information about monthlet, a free download of the app, registration for the monthlet AI waitlist, release notes, a press kit, documentation, and a way to contact us.

We do not currently offer any paid service, and no service that stores or synchronises your data on our servers. When we begin offering one, we will present separate terms for it before you start using it. Nothing in these terms is a commitment to launch such a service, and nothing here should be read as terms for one.

We may change, suspend, or discontinue any part of this website or the services offered through it. Where a change is material and disadvantageous to you, we will note it on this website in advance where it is reasonable to do so.

Downloading the app

The app is provided free of charge. Downloading it does not create a payment obligation.

The installer is hosted on GitHub Releases, so retrieving it involves GitHub as well, under GitHub’s own terms.

Your use of the app once installed is governed by the EULA.

System requirements are stated on the download page and in the release notes, and they change as the app is developed. Availability on a given operating system is a matter of fact at a point in time, not a term of this agreement.

The monthlet AI waitlist

You may register an email address to be told when monthlet AI becomes available.

Registering is not a purchase and not a reservation. It places you under no obligation, and it places us under no obligation to make the service available to you, to make it available at any particular time, or to offer it on any particular terms.

You can ask us to remove your registration at any time by writing to [email protected]. What we store and for how long is described in the Privacy Policy.

How you may use this website

You may read this website, link to it, and quote from it with attribution. The press kit page provides material intended for that purpose.

You may not: interfere with the operation of this website or the endpoints it uses; attempt to gain access to systems or data you are not authorised to access; place an unreasonable load on the service through automated access; or use this website for an unlawful purpose or in a way that infringes the rights of others.

The name, logo, page text, images, and video on this website belong to us or to the applicable rights holders, except where stated otherwise. The open source software included in the app is covered by its own licences, which these terms do not restrict.

Third-party services

This website links to services operated by others, including GitHub, Discord, X, YouTube, and note. Those services are governed by their own terms and privacy policies, and we are not responsible for their content or operation.

No warranty

This website and the services offered through it are provided "AS IS". To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including that the website will be available without interruption, that it will be free of error, or that the information on it is complete or current.

Information on this website, including anything describing planned features, reflects our intention at the time of writing and may change.

Limitation of liability

If you suffer damage caused by our willful misconduct or gross negligence, we will compensate you for that damage. In such cases, our liability is not limited.

If you suffer damage caused by our ordinary negligence (negligence other than willful misconduct or gross negligence), we will compensate you only for direct and ordinary damages actually incurred, up to a maximum of JPY 5,000. To the extent caused by our ordinary negligence, we are not liable for damages arising from special circumstances, lost profits, loss of data, or business interruption.

The two preceding paragraphs do not apply to the extent that such limitation of liability is not permitted under the Consumer Contract Act of Japan or other applicable law.

These limits mirror those in the EULA so that the same standard applies whether the matter concerns the website or the software.

Changes to these terms

If these terms change, we will update this page and the date above. Material changes will be noted on this page.

Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of Japan. Any dispute arising in connection with these terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Language. These terms are prepared in Japanese and in English. The Japanese version is the authoritative text; if the two differ, the Japanese version prevails.

Who operates this service

This website and monthlet are operated by t27d, an individual developer based in Japan. The operator’s legal name and address will be provided without undue delay on request at [email protected].
